On December 5, Donald Trump’s attorney, Marc Kasowitz argued with a New York state judge, saying that Trump is too influential and busy for state court.

Summer Zervos, a woman who accused Trump of sexual harassment, came to court for her defamation suit. Summer Zervos was on “The Apprentice” in 2006 when Trump was its host.  Zervos had said that Trump groped her and made unwanted sexual contact multiple times during a business meeting. Zervos is seeking an apology from President Trump and $3,000 for damages, such as Trump slandering her name.

“The motion today has nothing to do with putting anyone above the law,” Kasowitz told Judge Schecter. Under the Supremacy Clause, he said, “a state court may not exercise jurisdiction over the president of the United States while he or she is in office.” Marc Kasowitz pointed out to the judge that since Trump is president, he should have immunity to the punishment, but Zervos’ three lawyers disagreed.  The lawyers believe that the punishment should matter whether Trump is president or not. Kasowitz repeatedly claimed the importance of Trump and how he shouldn’t even waste his time in state court. Trump should pay the price, with an apology and the $3,000. Trump’s lawyer fought back and argued that Trump should have immunity to this case, due to the sole fact that he is president. Both Zervos and Trump are fighting hard to prove each other wrong. Judge Schecter is still making her decision, and until then, nobody has a clue on who will win this case.
